If you do not agree with any part of these Terms, you should not use our website or enroll in our programs. By continuing to use our services after these Terms are presented to you, you confirm that you have read, understood, and agreed to all of the conditions described here.
These Terms apply to all visitors, athletes, parents, guardians, coaches, volunteers, and representatives who interact with our organization in any capacity. When a parent or guardian registers a child for a program, that parent or guardian accepts these Terms on behalf of the child and agrees to ensure that the child follows our rules while participating.
2. About Our Services
Canyon View Water Polo Association, Inc. is a water polo and aquatics organization that provides youth water polo programs, competitive teams, learn to swim instruction, aquatics education, team training, clinics, tournament hosting, and coaching and officiating development. Our services are delivered at our home facility in Cedar City, Utah, and at partner venues where we run programs or host events.
Our website and related online tools are developed and operated by the developer CanyonView under our direction. The purpose of our digital services is to inform the community about our programs, to allow families to contact us, and to support registration and communication for our activities.
These Terms cover both our physical programs and our online services. Where a specific program has its own registration form, handbook, or event rules, those documents are considered part of these Terms, and you agree to follow them in addition to the general conditions described on this page.
3. Eligibility and Parental Consent
Our programs serve athletes of many ages. Youth programs are generally open to swimmers between the ages of ten and fourteen, subject to swimming ability and group capacity. Competitive teams and masters programs have their own age and ability requirements, which are published in program materials and discussed during enrollment.
Any individual under the age of eighteen must be registered by a parent or legal guardian. By registering a child, the parent or guardian confirms that they have the authority to enroll the child, that the information they provide is accurate, and that they accept these Terms on behalf of the child.
We reserve the right to verify eligibility, to refuse enrollment where a participant does not meet published requirements, and to place athletes in the group that best matches their age, skill, and experience. Our goal is to give every participant a positive and safe experience, and group placement is part of how we achieve that.
4. Registration and Accounts
To enroll in a program, you may be asked to complete a registration form that collects the information needed to participate, including contact details, emergency contacts, and relevant medical notes. You agree to provide accurate, complete, and current information and to keep that information up to date throughout the season.
If we provide you with an account, a schedule login, or access credentials, you are responsible for keeping those credentials secure and for all activity that happens under your account. You agree to notify us promptly if you believe your account has been accessed without your permission.
We may use the contact details you provide to communicate about your enrollment, including practice schedules, season updates, fees, and important safety notices. You may opt out of non essential communications at any time, though you will continue to receive messages that are necessary for the operation of the program you joined.
5. Program Fees and Payments
Many of our programs require payment of a registration or season fee. The amount of each fee, what it covers, and when it is due are described in program materials and on the registration form. You agree to pay all fees associated with the program or event for which you register.
Payments are processed through secure methods, and we or our payment partners may collect the information needed to complete a transaction. You agree that the payment details you provide are valid and that you are authorized to use them. We do not store card numbers on our own systems beyond what is required to process a refund or respond to a billing question.
Failure to pay required fees may result in a pause of participation, removal from a team roster, or loss of a reserved place in an event. If you have a genuine difficulty paying a fee, please contact us; our community tries to support families in good faith wherever we responsibly can.
6. Participant Conduct and Code of Behavior
Every participant, parent, coach, and volunteer is expected to treat others with respect at all times. Our code of behavior covers conduct in the water, on the pool deck, in the stands, and during travel. Bullying, harassment, intimidation, and abusive language are not tolerated in any form and may lead to discipline or removal from a program.
Participants agree to follow coach instructions, to respect pool rules, to care for equipment, and to represent the Association fairly at games, tournaments, and community events. Parents and guardians agree to support the coaching staff, to encourage good sportsmanship, and to communicate concerns through the appropriate channels rather than during practice or competition.
We reserve the right to address conduct issues with warnings, temporary suspension, or permanent removal depending on the seriousness of the behavior. In every case, decisions are made fairly, with the wellbeing of the group as the guiding consideration, and families are informed of the reason for any disciplinary action.
7. Health and Safety Responsibilities
Water polo is a physically demanding sport, and participation involves effort, contact, and the normal risks of swimming and athletic activity. You are responsible for providing accurate information about any medical conditions, allergies, or limitations that could affect safe participation, and for updating that information when it changes.
Participants are expected to arrive on time, to be ready for the water, and to tell a coach before practice if they are feeling unwell or injured. Our staff monitor the pool environment, follow emergency procedures, and are trained to respond to incidents. You agree to follow all safety rules and to accept the reasonable directions of lifeguards and coaches.
Parents and guardians must ensure that a responsible adult is available to collect young participants at the end of each session. We cannot supervise athletes beyond the scheduled activity time, and safe pick up is an important part of keeping every child safe.
8. Release and Assumption of Risk
Participation in water polo, aquatics instruction, and related activities involves inherent risks, including but not limited to slips and falls, contact with other players, impact with the ball, physical exertion, and the general risks of being in and around water. By enrolling in any program, you acknowledge these risks and agree to assume them voluntarily.
To the fullest extent permitted by law, you release and hold harmless Canyon View Water Polo Association, Inc., its officers, directors, coaches, staff, volunteers, and the developer CanyonView from claims, damages, and liability arising out of your participation or the participation of a minor in our care, except where caused by our gross negligence or willful misconduct.
This release is intended to be as broad as permitted by applicable law. If any part of this section is found to be unenforceable, the remainder of the section and these Terms will continue in full force and effect.
9. Media and Photograph Use
From time to time, we take photographs or video at practices, games, and events to celebrate our community and share program highlights. We may use such media in newsletters, on our website, on social media, and in promotional materials.
We do not publish media that identifies a minor athlete without the written permission of a parent or guardian. Registration forms include a media release option, and a parent or guardian may decline to grant media permission at the time of registration or by contacting us at any time.
If you request that media of you or your child be removed from our channels, we will make reasonable efforts to remove it from active publication, though content shared on third party platforms may require the cooperation of those platforms to remove fully.
10. Intellectual Property
All content on our website, including text, graphics, logos, images, course materials, drill libraries, and branding, is the property of Canyon View Water Polo Association, Inc. or its content providers and is protected by copyright, trademark, and other intellectual property laws.
You may view and print content for your own personal, non commercial use in connection with participating in our programs. You may not copy, reproduce, distribute, modify, or create derivative works from our content for commercial purposes without our prior written permission.
Our name, logo, and branding may not be used in connection with any product or service that is not ours without our prior written consent. We appreciate the support of our community and ask that everyone helps protect the identity and reputation of the Association.
11. Website Use Rules
You agree to use our website only for lawful purposes and in a way that does not interfere with the operation of the site or the experience of other visitors. You may not attempt to gain unauthorized access to any part of the site, to overload the servers, or to introduce harmful code.
You agree not to misuse any content on the site, not to scrape or harvest data, and not to use the contact form or any other communication channel to send spam, false information, or offensive material. We reserve the right to restrict access to the website or any feature at our discretion.
While we work to keep the website available and accurate, we do not guarantee that the site will be uninterrupted or error free, and we may update content or change features at any time without notice.
12. Tournament and Event Terms
When you register for a tournament or event that we host, additional terms may apply. These include event schedules, venue rules, referee decisions, and any waivers required by the facility or governing body. Registration for an event confirms your agreement to those terms as well as these Terms of Service.
Team rosters and contact details shared with us for event purposes are used to organize the competition and may be shared with event partners as described in our Privacy Policy. Participants agree to follow the conduct expectations of the event and to accept the decisions of referees and officials.
Events are subject to change based on weather, facility availability, or other circumstances. If an event is cancelled by us, we will apply the published cancellation and refund policy, which is also described in the section on refunds below.
13. Coaching and Officiating Services
Our coaching and officiating development services are offered to individuals and to outside teams and schools. When an outside organization engages our coaching services, the responsible representative agrees to these Terms on behalf of that organization and confirms the accuracy of the information provided during booking.
Custom training sessions and clinics are scheduled based on mutual agreement and may be subject to a minimum attendance or a booking fee. Our coaches bring their best effort to every session, and organizations are expected to ensure that their participants are registered, informed, and properly prepared.
Officiating clinics and referee development activities follow the rules of the sport and the requirements of the governing body. Certification outcomes depend on individual performance and are not guaranteed by attendance alone.
14. Refunds and Cancellations
Our refund policy is designed to be fair to families and to keep our programs sustainable. Because fees cover facility time, coaching, and equipment that are arranged in advance, refunds are generally limited to specific circumstances described in program materials.
If you must withdraw from a program before it begins, we will work with you to provide a refund or credit according to the published schedule. Withdrawals after a program has started are typically not eligible for a refund, though we review hardship cases individually and with kindness.
If we cancel a program due to insufficient enrollment, facility issues, or other reasons, registrants receive a full refund or the option to transfer their fee to another program. Event cancellations follow the published event policy.
15. Disclaimer of Warranties
Our website and services are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non infringement.
We do not warrant that the website will be uninterrupted, timely, secure, or error free, that results obtained from the use of the services will be accurate or reliable, or that any content will be current or complete. You use the website and services at your own discretion and risk.
Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the exclusions in this section may not apply to you. To the extent allowed by law, the exclusions in this section apply to the maximum extent permitted.
16. Limitation of Liability
To the fullest extent permitted by law, Canyon View Water Polo Association, Inc. and the developer CanyonView will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of our website or participation in our services.
Our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid to us in connection with the specific program or event giving rise to the claim, or one hundred dollars if no payment was made, whichever is greater.
The limitations in this section apply whether the claim is based in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some limitations may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless Canyon View Water Polo Association, Inc., its officers, directors, coaches, staff, volunteers, agents, and the developer CanyonView from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another party.
If you register a minor, this indemnification also applies to conduct arising from the participation of that minor, to the extent permitted by law. This obligation survives the termination of your use of our services and these Terms.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification, in which case you will cooperate with us in asserting any available defenses.
18. Termination of Services
We may suspend or terminate your access to our website or your participation in a program if you violate these Terms, engage in conduct that endangers others, or fail to pay required fees. We will make reasonable efforts to inform you of the reason for any termination where circumstances allow.
You may terminate your participation in a program at any time by notifying our office. Termination of a program does not affect obligations that arise before termination, including payment obligations for services already rendered and the application of the refund policy.
Provisions of these Terms that by their nature should survive termination, including releases, indemnification, disclaimers, and limitations of liability, will continue to apply after any termination of services.
19. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Utah and the federal laws of the United States, without regard to conflict of law principles. Any legal action arising out of or relating to these Terms will be brought exclusively in the courts located in the State of Utah.
You agree to submit to the personal jurisdiction of those courts and to waive any objection based on an inconvenient forum. Before initiating any legal proceeding, we encourage parties to attempt in good faith to resolve disputes informally by contacting our office.
If a dispute cannot be resolved informally, the prevailing party in any legal proceeding may be entitled to recover its reasonable costs and attorney fees, to the extent permitted by law.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, that provision will be severed from these Terms.
The invalidity or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions, which will continue in full force and effect.
The parties intend each provision of these Terms to be read and applied independently, so that the intent of the agreement is preserved even if one part cannot be enforced.
21. Entire Agreement
These Terms, together with our Privacy Policy and any program specific documents, forms, or handbooks that apply to a particular service, constitute the entire agreement between you and Canyon View Water Polo Association, Inc. regarding your use of our services.
This agreement supersedes all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter of these Terms. If there is a conflict between these Terms and a program specific document, the more specific document governs for that program, unless it conflicts with a mandatory legal requirement.
No failure or delay by us in exercising any right under these Terms will operate as a waiver of that right, and no waiver of a breach will constitute a waiver of any subsequent breach.
22. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our practices, in the law, or in the way we operate. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify our community through the contact information we have on file.
Continued use of our website or continued participation in our programs after a change takes effect constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically so that you remain informed about the conditions that apply to your participation.
If you do not agree with a change to these Terms, you may stop using our services and contact us to discuss your options, including any applicable cancellation and refund process.
